Terms governing your use of the Camera Sync service.

These Terms of Service ("Terms") govern your use of the Camera Sync service and related websites ("Service") operated by Camera Sync ("we", "our", or "us"). By signing up or using the Service, you agree to these Terms.

Description of the service

Camera Sync provides a bridge between your camera and Google Photos. You configure your camera to upload photos via FTP, FTPS, or SFTP to our servers; we then transfer those photos to a designated album in your Google Photos account. We do not store your photos permanently—they pass through our systems only for the duration of the transfer.

Account and eligibility

  • You must have a Google account to use the Service. You sign in with Google to create and access your Camera Sync account.
  • You must be at least 13 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract.
  • You are responsible for keeping your account credentials secure and for all activity under your account.

Subscription and billing

  • Free tier: We offer a free tier with limited uploads per month as described on the website. We may change free tier limits with reasonable notice.
  • Pro tier: Paid subscriptions ("Pro") are billed monthly (or as otherwise stated) in advance. Fees are non-refundable except where required by law or as stated in our refund policy.
  • Payment: Payments are processed by Stripe. By subscribing, you agree to Stripe's terms and our billing policies. You must provide valid payment information and keep it updated.
  • Price changes: We may change subscription prices with at least 30 days' notice. Continued use after the change constitutes acceptance.
  • Cancellation: You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws.
  • Upload content you do not have the right to upload, or that infringes others' intellectual property or privacy.
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any third-party systems.
  • Abuse, overload, or disrupt the Service or our infrastructure.
  • Resell or sublicense the Service without our written permission.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or abused the Service.

Intellectual property

The Service (including software, design, text, and branding) is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use in accordance with these Terms. You do not acquire any ownership rights in the Service.

You retain ownership of your content (e.g., photos). By using the Service, you grant us the limited rights necessary to receive your uploads and transfer them to your Google Photos account as configured by you.

Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
  • Our total liability for any claims arising from or related to the Service or these Terms is limited to the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow certain disclaimers or limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your account or access to the Service for violation of these Terms, non-payment, or for any other reason with notice where practicable.
  • Upon termination, your right to use the Service ceases. We may delete your account data as described in our Privacy Policy.

Changes to the terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through the Service. Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service and may delete your account.

General

  • Entire agreement: These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right or provision does not waive that right or provision.
  • Governing law: These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes are subject to the exclusive jurisdiction of the courts in that jurisdiction (or as required by mandatory law in your country).
